VILLA BIMITI RENTAL AGREEMENT

TERMS AND CONDITIONS
All Bookings for Villa Bimiti, The Chalet at Villa Bimiti and The Studio at Villa Bimiti herein referred to as The Villa, The Chalet and The Studio respectively, are subject to the terms and conditions listed in this Rental Agreement.

  1. PAYMENT TERMS AND CANCELLATION POLICY
    1.1. A minimum of 20% deposit of your total Villa and/or Chalet rental is required to confirm your reservation, with the full payment, due thirty (30) days prior to arrival date.
    1.2. If the booking is made within thirty (30) days of your arrival, full payment is required at the time of booking and is not refundable.
    1.3. All reservations are valid for a full refund if cancelled no less than thirty (30) days prior to the scheduled arrival date. All cancellations made after the aforementioned period are non-refundable.
    1.4. Special advance purchase rates may require full prepayment at the time of reservation and are non-refundable.
    1.5. If you have booked through an online travel agency (OTA), the agency’s Cancelation policy will apply.
  2. ACCOMMODATION
    2.1. The accommodation provided at the Villa and/or Chalet is only for the number of people stated on the initial reservation and named on the Booking Form, which is emailed to you as part of the reservation process. Subletting, sharing, or assigning is prohibited and will be deemed as a breach of contract, and all guests may be asked to leave the Villa and/or Chalet without any viable claim for compensation.
    2.2. Guests may NOT conduct business of a service nature e.g. sales, promotions, hairdressing, provision of spa treatments etc. to paying clients on the premises, unless by prior formal arrangement with management. Additional charges may apply. Any persons not named on the attached Booking Form will, in all cases, be asked to leave the Villa/Chalet by our management agents. This to include any unauthorized prospective clients.
    2.3. The Villa/Chalet rental is only for the dates and times agreed to in the rental agreement. If the Villa/Chalet is occupied outside the agreed rental dates and times, the owner has the right to additional compensation.
    Deductions will automatically be made from your refundable damage deposit.
    2.4. This is a non-smoking, drug free property.
  3. REFUNDABLE DAMAGE DEPOSIT (RDD)
    3.1. For direct bookings, a refundable damage deposit (RDD) of one night stay is accepted to cover accidental damage or incidentals. The RDD will be refunded within 14 days of guest departure, once management has established that there is no damage to any part of the Villa/Chalet or to its contents, and that there are no unpaid incidental charges. The RDD will be refunded to an account provided by the guests, and NOT paid in cash. 3.2. If the RDD does not cover any necessary remedial work, responsibility for the excess remains the responsibility of the guests named on the Booking Form, and an invoice for the additional amount will be issued. 3.3. For online travel agency (OTA) reservations, the agency’s policy regarding RDDs, and/or insurance will apply.
  4. CHECK IN/CHECK OUT
    4.1. Check-in time is 3.00pm. Check-out time is 11.00 am.
    4.2. Requests to change the check-in and/or check-out times will be accommodated when possible. Please be aware that management cannot always accommodate such requests, especially in high season or at peak travel times.
  5. LIABILITY
    5.1. Neither we, the owners, nor the management agents will accept any liability whatsoever for accidents, personal injury, death, loss and/or damage to persons, vehicles and/or personal effects however caused.
    5.2. We will not accept any responsibility for any liability arising from use of the pool, the Villa/Chalet and its contents, or surrounding areas.
    5.3. Your security is important. Please note that you are responsible for always securing the property during your stay, both for your safety, your possessions, and the contents of the Villa/Chalet.
    5.4. Glassware or other breakable items must not be taken out to the patio/pool area. Plastic glasses are provided.
  6. PARKING
    6.1. There is assigned parking for booked guests within the gates of the property.
    6.2. Parking is limited to the vehicles listed on the Booking Form.
  7. PARTIES
    7.1. The following are not allowed:

    7.1.3. Loud Music
    7.2. After Hours – We like to be respectful of our neighbors and therefore we ask you to keep noise levels to a minimum after 10:00pm.
  8. POOL
    8.1. The pool is for the use of guests named on the attached Booking Form and any guests in the Villa or Chalet.
    8.2. Please exercise care and attention when using the swimming pool as no liability will be accepted for use of the pool. (See Clause 7.2 above).
    8.3. Guests are encouraged to use the outdoor shower before entering the pool.
    8.4. No glassware is to be used around or in the pool. Plastic drink ware is provided.
  9. VISITOR POLICY
    9.1. Villa and/or Chalet management must always be aware of the number and identity of persons on the property at any given time. Adherence to this policy is mandatory and it will be monitored by management.
    9.2. Villa and/or Chalet guests may NOT conduct business of a service nature e.g. sales, promotions, hairdressing, provision of spa treatments, photographic services etc. to paying clients on the premises.
    9.3. Villa and/or Chalet guests violating the above will be asked to leave the premises with no refund.
  10. AIR CONDITIONING
    10.1. Please close all windows and doors when using the air-conditioning units. This will ensure that the rooms remain cool and help to ensure that the units remain efficient.
    10.2. When leaving the bedrooms, please turn off the air-conditioning units, in the interest of the
    environment and energy conservation.
  11. HOUSEKEEPING
    11.1. Prior to your arrival:
    The Villa and/or Chalet will be professionally cleaned and sanitized. Therefore, please respect the efforts that we have made to prepare the Villa/Chalet for your comfort and safety.
    11.2. During your stay:
    Housekeeping Staff and Maintenance Personnel will be on property and may access all areas of the Villa and/or Chalet for cleaning, sanitizing or maintenance purposes.
    The housekeeper is responsible for changing and laundering towels as needed. Bed linen will be changed every third day, or as needed. Villa and/or Chalet guests are asked to kindly vacate the immediate areas that need to be cleaned while the housekeeping staff are cleaning.
    11.3. You are welcome to use the washer and dryer for personal items, however, we ask that you refrain from using bleach. Only HE detergent.
    11.4. Please do NOT move furniture. If furniture movement causes damage to the furniture or scratches the wooden floors, repair of same will be deducted from the RDD.
  12. THE TROPICAL REALITY
    12.1. Tobago is a tropical island, and insects are part and parcel of life. Their presence in no way reflects the
    cleanliness of the Villa and/or Chalet, and as such is neither cause for complaint nor compensation.
    12.2. We ask you not to store or eat any food, snacks, fruit or drinks in the bedrooms.
    12.3. Only water is allowed in the bedrooms.
    12.4. We recommend clearing all crumbs and food particles from the eating areas to try and avoid these uninvited visitors. In the unlikely event of such problems, please call the management agents who will endeavor to address the problem as soon as possible.
  13. NO SMOKING AND ZERO DRUG TOLERANCE POLICY 13.1. Villa Bimiti – The Villa and/or Chalet is a no smoking property. Smoking and Vaping are not permitted anywhere on the premises. 13.2. Fireworks and incendiary devices of any kind are NOT permitted on the property. This includes scented candles, incense etc. Failure to adhere to this rule will result in the loss of the guests’ refundable damage deposit. 13.3. The use and/or possession of illegal drugs is strictly prohibited and will result in guest removal from the property without compensation. This will also incur forfeiture of the guests’ refundable damage deposit. 13.4. Please note that although the use of small quantities of marijuana may be legal in your own home in Trinidad and Tobago, Marijuana use is NOT permitted inside the Villa and/or Chalet or anywhere on Villa Bimiti’s premises!
  14. 14.FIREARMS AND CAMOUFLAGE 14.1. Firearms are not permitted on the property unless by prior arrangement with management. Failure to adhere to this rule will result in the removal of the guest and their party from the property without compensation. This will also incur forfeiture of the guests’ refundable damage deposit. 14.2. Please note that no camouflage items including clothing may be brought into Trinidad and Tobago – it is against the law to possess or wear it!
  15. COMPLAINTS If there is any reason for complaint or dissatisfaction, guests must immediately contact the management agents, so that remedial action may be taken. Contact details for the management agents are in your Welcome Guide. If the management agents cannot deal with the complaint during your stay, then you must put it in writing to the owners within 14 days of departure from the Villa and/or Chalet. All complaints must be made to the management agents first; otherwise, the owner has the right to refuse to uphold the guests’ complaint.
  16. FORCE MAJEURE Neither the owners, nor our management agents, will accept or be held responsible/liable for any loss, damage, injury or changes due to force majeure (e.g., civil action, war or threat of, strikes, riots, closure of airports, prevailing weather conditions including hurricane/tornado etc., acts of God or terrorism, or any other events beyond our control). Guests should be aware that the hurricane season in Tobago runs from June to October. No liability is accepted by the owner for loss of any mains services or failure of appliances, nor for the consequences of the actions or omissions of persons who may control supply of mains services, nor any actions taken in the vicinity of the property by any authority over which there is no control by the owner. This includes outages of mains services caused by adverse weather conditions as all are considered changes due to force majeure. It is strongly recommended that guests take out vacation insurance to cover cancellation fees and any other losses that may occur. When you book The Villa, The Chalet or The Studio, you signify that you have read and agree to the above Villa Bimiti Rental Agreement.
